Implementation of the First Optional Protocol to Pact II

Switzerland has not, to this day, ratified the First Optional Protocol  to the International Covenant on Civil and Political Rights (ICCPR-OP1) of 16 December 1966. It gives the Human Rights Committee (HRC) competence to examine individual complaints with regard to alleged violations of the Covenant by States parties to the Protocol. In the Federal Council report planning the 1999-2003 legislation, the will to submit a message for the ratification of this Protocol to the Parliament is clearly stated. However, this objective is not mentioned in the report planning the 2003-2007 legislation.

The body that monitors the implementation of the ICCPR is the Human Rright Committee.



Second Optional Protocol to Pact II: abolition of death penaly

Entry into force in Switzerland on 16 September 1994
Message on 3 February:  BBI FF 1993 I 995/943/787

This treaty could be ratified by Switzerland on 16 June 1994, after the Parliament abolished death penalty in the military penal law.
