Reservations by Switzerland to the Convention against Discrimination of Women
Switzerland made the following three reservations when ratifying the Convention:
- The reservation concerning article 7 (b) ( right to to hold public office and perform all public functions at all levels of government: According to Swiss military legislation, women are prohibited to perform functions involving the use of firearms, except in self-defence) was withdrawn in 2004.
- Reservation concerning article 15, paragraph 2 (equallegal capacity) and article 16 para. 1(h) (equal right to acquisition, ownership, management, administration, enjoyment and disposition of property) According to several interim provisions of the matrimonial regime (Civil Code, articles 9 (e) and 10, final section), spouses who were married under the pre-1984 matrimonial regime had the possibility to keep the old regime.
- Reservation concerning article 16, paragraph 1 (g) which ensures the same personal rights to husband and wife, including the right to choose a family name. According to the Civil Code, article 160 and article 8 (a), final section, the husband's family name becomes the name of both spouses.
